Membership in the WTO will support the further development of the rule of
law in China. This will aid foreign companies in several ways:
Greater
transparency, impartial dispute settlement, and other features
of China's WTO membership will benefit small foreign companies
in particular -- in view of their limited resources and the
particular challenges they face in dealing with China's often
complex legal and regulatory policies.
Through WTO dispute settlement, foreigners would gain a stronger means
for ensuring Chinese compliance with its obligations. China
has agreed to subject its decisions to impartial review, and
ultimately imposition of sanctions if necessary -- and China
will not be able to block panel decisions. If China loses a
dispute, it will have to change the offending practice,
provide compensation, or be subject to denial of access to the
world market in an amount proportional to the harm it causes.
Foreign member countries will be the most frequent user of the
WTO dispute settlement mechanism, obtaining favorable results
so far on 23 of the 25 complaints that they have initiated and
that have been acted upon.
